1. About these terms
These terms apply to every person who accesses this website, makes or pays for a booking, purchases an event ticket, attends the premises or otherwise uses the venue.
By submitting a booking request, making payment or entering the premises, you confirm that you have read, understood and agreed to these terms, our House Rules and our Privacy Notice.
Where a booking is made on behalf of another person, the person making the booking is responsible for ensuring that every attendee has read and agreed to the applicable terms before attending.
2. Venue operator
Wirral Glory Hole is a private adults-only venue operating from Dock Road, Birkenhead, CH41 1BL.
The venue operator's full legal or registered business name, business address and contact details should be displayed on this website and on booking confirmations.
References in these terms to “we”, “us”, “our” or “the venue” mean the person or legal entity operating Wirral Glory Hole. References to “you”, “your”, “guest” or “attendee” mean anyone booking, paying for or attending the venue.
3. Adults only
The venue is strictly limited to people aged 18 or over. No person under 18 may book, attend, enter the premises or be included in a booking under any circumstances.
Attempting to gain access while under 18, using another person's identification or helping an underage person gain access will result in immediate refusal, cancellation without refund and possible referral to the police.
We operate a strict age-verification policy and may ask for identification at any stage of the booking or entry process.
4. Identification and verification
Every attendee must provide valid, current, government-issued photographic identification when requested. Accepted identification is normally a passport or photocard driving licence.
The photograph, name, date of birth and other relevant details must be clear and must match the person attending. Screenshots, edited images, expired documents, photocopies and identification belonging to another person will not be accepted.
A booking may require an identification image and a current matching selfie before it is confirmed. Original physical identification may also be required at the door.
Submitting identification does not guarantee acceptance or entry. We may request further verification where information is incomplete, unclear or inconsistent.
Identification information is handled in accordance with our Privacy Notice. You must not submit another person's identification without their informed permission.
5. Booking process
All visits must be booked in advance unless we expressly state otherwise. Walk-in access is not guaranteed and may be refused.
Submitting the online form creates a booking request only. A booking is not confirmed until we have approved it and, where payment is required, received cleared payment.
Booking availability is shown in good faith but may change before confirmation. Automated acknowledgements do not amount to acceptance of a booking.
You are responsible for supplying an accurate name, date of birth, telephone number, identification information and any other details requested during booking.
We may contact you by WhatsApp, SMS, telephone or email concerning verification, payment, access instructions, safety or changes to your booking.
6. Prices and payment
The price payable is the price shown or communicated before payment, including the selected session length, ticket type and any optional extras.
Payment must be completed using the payment method and within the time stated in your payment request. An unpaid booking may be released without further notice.
Discount codes must be entered or accepted before payment. They cannot normally be applied retrospectively, exchanged for cash or combined unless expressly stated.
Your bank statement may display the legal or trading name of the payment recipient rather than the public venue name. The applicable descriptor should be disclosed before payment.
You must not make an unauthorised payment, use a payment method without the account holder's permission or initiate a dishonest chargeback. Suspected fraud may be reported to the payment provider or police.
7. Cancellations, rescheduling and refunds
Unless different cancellation terms are clearly displayed before purchase, you may cancel or request one change to your booking at least 24 hours before its scheduled start time.
Eligible cancellations made at least 24 hours before the start time will receive a refund to the original payment method. Eligible change requests remain subject to availability.
Bookings cancelled less than 24 hours before the start time, missed bookings and refused entry caused by a breach of these terms are normally non-refundable because the reserved time may not be capable of being resold.
Where reasonably possible, we may choose to offer a discretionary change or credit, but doing so on one occasion does not require us to do so again.
Bookings for leisure services provided on a specified date or during a specified period may fall outside the usual statutory 14-day cancellation right. Nothing in these terms removes any cancellation or refund right that applies by law.
8. Changes or cancellation by us
We may change, delay, suspend or cancel a booking where reasonably necessary because of safety concerns, staff availability, property issues, equipment failure, emergencies, suspected misconduct, legal requirements or circumstances outside our reasonable control.
Where we cancel a booking and you are not responsible for the cancellation, we will normally offer a replacement booking, account credit or refund of the amount paid for the affected service.
We are not responsible for unrelated expenditure such as travel, accommodation or other consequential costs unless liability cannot lawfully be excluded.
9. Arrival, lateness and session times
You must arrive at the agreed time and follow the arrival instructions supplied with your booking. Do not arrive significantly early, wait outside in a way that obstructs neighbouring premises or attempt to enter before being invited.
Your booking begins and ends at the scheduled times. Arriving late does not extend the end time and may result in a shortened session.
If you arrive more than 15 minutes late, we may treat the booking as missed and refuse entry without a refund.
When the white session light switches off, your booked time has ended. You must stop, collect your belongings, dress where applicable and leave the session area and premises promptly.
Remaining beyond your allotted time without permission may result in an additional charge, removal from the premises or restrictions on future bookings.
10. Consent and personal boundaries
All interaction at the venue must involve adults who freely and actively consent. Consent must be specific, informed, ongoing and capable of being withdrawn at any time.
Previous consent, attendance at the venue, payment, clothing, silence, intoxication or participation in another activity does not amount to consent.
The venue safe word is RED. Saying RED, withdrawing consent, showing clear distress or giving an instruction to stop means that all relevant activity must stop immediately.
No person may pressure, manipulate, intimidate, threaten, restrain or coerce another person into any interaction.
Ignoring a refusal, withdrawal of consent, safe word, venue rule or staff instruction will result in immediate intervention and removal. Serious matters may be preserved as evidence and reported to the police.
A person who is asleep, unconscious, heavily intoxicated, incapacitated or otherwise unable to make a free and informed decision cannot consent.
11. Prohibited conduct
The following conduct is prohibited throughout the premises, including entrances, corridors, waiting areas, session areas and toilets:
- Harassment, stalking, intimidation, threats, aggression, coercion or violence.
- Non-consensual contact or continuing after consent has been withdrawn.
- Discriminatory, degrading or abusive behaviour towards guests, staff, contractors or neighbours.
- Photography, filming, audio recording, livestreaming or video calling without our express written permission and the informed consent of every identifiable person.
- Sharing another attendee's identity, image, booking details or personal information without permission.
- Possessing weapons, imitation weapons, illegal drugs or any item reasonably considered dangerous.
- Selling, supplying, exchanging or consuming illegal substances.
- Soliciting, advertising or conducting unauthorised commercial activity on the premises.
- Tampering with locks, lights, alarms, cameras, safety equipment, barriers, furnishings or venue equipment.
- Entering staff-only, restricted or unbooked areas.
- Bringing an unregistered guest or allowing another person to use your booking.
- Causing excessive noise, nuisance, obstruction or disturbance to neighbouring premises.
- Deliberately damaging, soiling or misusing the premises or equipment.
12. Alcohol, drugs and fitness to attend
You must not attend while heavily intoxicated, impaired by drugs or otherwise unable to understand instructions, assess risk or give valid consent.
Illegal substances are strictly prohibited. Medication must not be supplied to another person.
We may refuse entry or end a session where we reasonably believe that a person is intoxicated, impaired, medically unwell, behaving unpredictably or unable to participate safely.
Refusal or removal arising from your condition or conduct will normally be without refund.
13. Health, hygiene and safer participation
You must not attend if you have symptoms of a contagious illness, an unexplained rash, open or infectious wounds, vomiting, diarrhoea or any condition that could reasonably create a health risk to another person.
Condoms, lubricant and hygiene supplies may be provided. You are responsible for choosing whether and how to participate, communicating boundaries and taking reasonable precautions appropriate to the activity.
You must follow all displayed hygiene instructions and leave the area reasonably clean. Used condoms, wipes and similar items must be placed in the bins provided and must not be flushed.
Do not use venue furniture or equipment in a manner for which it was not intended. Stop immediately if equipment appears damaged or unsafe and inform a member of staff.
Nothing provided by the venue constitutes medical advice, a medical assessment or a guarantee against pregnancy, infection, injury or other health consequences.
14. Staff instructions and right to refuse entry
Staff decisions concerning immediate safety, identification, intoxication, consent, capacity, entry and removal must be followed.
We may reasonably refuse entry, stop a session, require a person to leave, cancel future bookings or prohibit future access where we believe these terms have been breached or where doing so is reasonably necessary to protect guests, staff, the premises or the public.
You must leave immediately when instructed. Refusing to leave may constitute trespass and may result in security or the police being contacted.
A removal or ban may be issued without prior warning where the circumstances are serious. We are not required to disclose confidential information about another person when explaining a decision.
We will not refuse service for an unlawful discriminatory reason.
15. CCTV, security and privacy
CCTV operates 24 hours a day in designated security and access areas for the prevention and detection of crime, the protection of guests, staff and property, and the investigation of incidents.
CCTV locations will be indicated by appropriate signage. Cameras must not be installed or directed in areas where a person would reasonably expect complete privacy, such as toilets or changing areas.
CCTV footage is accessed only where reasonably necessary and may be supplied to the police, emergency services, insurers, legal advisers or other authorised recipients where lawful and appropriate.
CCTV footage, identification information, booking records and contact details are processed in accordance with our Privacy Notice and applicable data-protection law.
Guests must not obstruct, cover, move, disconnect or interfere with any security camera, alarm, access-control system or safety device.
16. Personal belongings
You remain responsible for your clothing, telephone, money, identification and other personal belongings while attending.
Do not bring unnecessary valuables. Any storage supplied is used at your own risk unless loss or damage is caused by our failure to exercise reasonable care.
Items left behind may be securely retained for a reasonable period and then disposed of where they are not claimed. Illegal or dangerous items may be passed directly to the police.
17. Damage, cleaning and additional costs
You are responsible for deliberate damage and for damage caused by your reckless or negligent conduct.
Where reasonably supported by evidence, we may seek the reasonable cost of repairing or replacing damaged property or carrying out cleaning substantially beyond that normally required after a booking.
We will not impose an arbitrary penalty. Any amount claimed will reflect the reasonable loss or expense caused by the incident.
Serious or deliberate damage may be reported to the police and may result in civil recovery action.
18. Events and additional rules
Specific events may have additional entry requirements, timings, capacity limits, dress requirements or conduct rules. These will be displayed before purchase or communicated before attendance.
Event-specific rules form part of these terms. Where an event-specific provision conflicts with these general terms, the event-specific provision applies to that event, except where doing so would remove a statutory right.
Tickets and bookings may not be resold, transferred or commercially advertised without our permission.
19. Accessibility and reasonable adjustments
Guests who require a reasonable adjustment should contact us before booking or as soon as reasonably possible.
We will consider reasonable requests individually, taking account of the premises, safety requirements and the adjustment requested.
Guests should not assume that every area or facility is accessible without first checking with us.
20. Liability and consumer rights
We will provide booked services with reasonable care and skill. Nothing in these terms excludes or limits rights or remedies that cannot legally be excluded.
We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded.
We are not responsible for loss or damage that was not reasonably foreseeable when the booking contract was made, was caused by your breach of these terms or resulted from circumstances outside our reasonable control.
We are not responsible for personal choices or consensual interactions between independent adult attendees, except to the extent that responsibility arises from our own acts, omissions or legal duties.
Nothing in these terms limits your statutory rights under the Consumer Rights Act 2015 or other applicable consumer law.
21. Complaints and incident reporting
Complaints or safety concerns should be reported to a member of staff as soon as possible so that immediate action can be considered.
After leaving the premises, you may contact us using the details published on the website. Include your booking reference and enough information for the matter to be reviewed.
We may preserve relevant booking records, access logs and CCTV footage when an incident, complaint, payment dispute, insurance matter or legal claim is reported.
Nothing in these terms prevents you from contacting the police, emergency services, a regulator or another appropriate authority.
22. Suspension and permanent bans
We may suspend or permanently prohibit a person from booking or attending where we reasonably consider that they pose a safety, safeguarding, fraud, harassment, privacy or operational risk.
Attempts to avoid a suspension or ban by using different contact details, identification, payment methods or another person's booking may be treated as a further breach.
Information necessary to administer a proportionate blocklist will be handled in accordance with our Privacy Notice and applicable data-protection law.
23. Severability and enforcement
If any provision of these terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
A delay in enforcing a provision does not waive our right to enforce it later.
These terms do not create rights enforceable by a person who is not a party to the relevant booking contract, except where the law provides otherwise.
24. Governing law
These terms and any dispute or claim arising from them are governed by the laws of England and Wales.
You may bring proceedings in the courts with jurisdiction under applicable consumer law. Nothing in this section removes any right you have to bring a claim in another part of the United Kingdom where the law permits it.
25. Changes to these terms
We may update these terms to reflect operational, legal, safety or regulatory changes.
The version presented to you when your booking contract is formed will normally apply to that booking. Changes will not be applied retrospectively where doing so would unfairly reduce an existing right.
The current version and its last-updated date will remain available on this page.
